First degree murder for George Milton?

Introduction

 38 year old George Milton is being accused of killing his own friend, 34 year old Lennie Small. Lennie Small, an intellectually disabled man, was shot in the back of the head near the brush right before 2:00pm on Saturday, July 10th 1932. Police got a call saying that there had been a gunshot and rushed over to investigate the scene.

What really happened.

 At the crime scene the police interviewed two men who were there. Curley Tyler and  Carlson Smith who are ranch workers nearby. I asked the prosecutors of what proof they had of George Milton committing first degree murder. They told me,”George Milton admitted to killing Lennie Small ”. Prosecutors also said there was no witnesses that saw George Milton brutally kill Lennie Small. Prosecutors told me that Mr. Tyler’s wife, was killed along with a small puppy which was found next to her in barn on the ranch that Lennie Small and George Milton worked on. Lennie Small was very strong and big, a 6’6 man with huge hands. Curley Tyler said,” It was Lennie Small that killed my wife and that pup no doubt about it. He also tried to fight me in the bunkhouse and he crushed my hand”. Did George kill Lennie so that Lennie would not hurt anything else?
